It was an agreement among 46 states, between those states' attorney generals and the tobacco industries. Such an agreement would need the consent of Congress via the Compact Clause. It also encroaches on federal power by regulating interstate commerce beyond the jurisdiction of any individual state. At the time, Congress rejected a similar measure.

And it was awful how it forced states to join the compact, since smokers in EVERY STATE would have to pay for the settlement, but a state wouldn't receive and of the settlement if it didn't join the unconstitutional compact.

So in the name of preventing cancer, we encouraged a different type of cancer inflicted on society by trial lawyers.

By the way, it is lovely to have an antagonist on my website. If you get more annoying, you will be banned, Nope.

Heh, I would like for you to articulate a legal argument for the unconstitutionality of the settlement. This should be fun to read.
