From Friday’s show:

The multi-state tobacco settlement was unconstitutional, and after years of hearing some Ohio Republicans bragging about their role in the tobacco settlement, I’m glad to see the settlement exposed for what it really is: The stealing of profits from a legitimate industry.

This is a perfect example of how unprincipled and unconservative so many elected Ohio Republicans are. Not only is the so-called “stimulus package” a bi-partisan effort, but even those Republicans who opposed taking the money from the Ohio Tobacco Prevention Foundation frame their opposition in terms of wanting a nanny state to have the money it needs to keep nagging Ohioans to stop enjoying tobacco products. Lame.

I agree with your premise…….but since they got the money they should use it for what it was designated for.

I thought it was Jay Hottinger, a Republican, that came up with this idea. How is that liberals fault?

  3. 3 Nope.

Heh, I would like for you to articulate a legal argument for the unconstitutionality of the settlement. This should be fun to read.

It was an agreement among 46 states, between those states’ attorney generals and the tobacco industries. Such an agreement would need the consent of Congress via the Compact Clause. It also encroaches on federal power by regulating interstate commerce beyond the jurisdiction of any individual state. At the time, Congress rejected a similar measure.

And it was awful how it forced states to join the compact, since smokers in EVERY STATE would have to pay for the settlement, but a state wouldn’t receive and of the settlement if it didn’t join the unconstitutional compact.

So in the name of preventing cancer, we encouraged a different type of cancer inflicted on society by trial lawyers.

By the way, it is lovely to have an antagonist on my website. If you get more annoying, you will be banned, Nope.

So now we need to smoke to keep the economy going?

This state is addicted to tobacco tax revenue.

It will also, by design, get addicted to casino taxes/money.
